Proprietorship Registration
The sole proprietorship is the simplest business form under which one can operate a business. The sole proprietorship is not a legal entity, it simply refers to a person who owns the business and is personally responsible for its debts.
Business with small capital requirements and low levels of risk opt for being run as sole proprietorships. Many ‘Kirana’ shops, small home-based ventures and often startups with a sole founder (at least in their initial stages) are structured as sole proprietorships.
Documents Required for Proprietorship Registration
To register a sole Proprietorship, the following documents are required:
- Colour Photo with White Background
- Aadhar Card
- PAN (Permanent Account Number) Card
- Cancelled Cheque
- Registered Office/Residence Address Proof: Voter ID Card, Driving Licence, Passport, Bank Statement, Electricity Bill
Advantages
- Easy to Start and Close:
Sole proprietorship can be easily started or dissolved at any time with minimum legal formalities. No separate law governs sole proprietorship. So, it can be started or closed down easily at the will of the proprietor.
- Quick Decision Making:
Sole proprietor enjoys complete freedom in taking the decisions. Timely decisions help you to take advantage of market opportunities as and when they arise.
- Low Overheads:
Sole proprietorship involves low overheads because the sole proprietor manages the business affairs himself. Thus, managing cost is quite low, resulting in low overheads on account of
managing costs. - Minimum Government Regulation:
The operations of a sole proprietor are regulated by government and law to the minimum extent. You have to comply with tax and labour laws, but otherwise, you are free from interference. The PAN of the proprietor and proprietorship is one. Thus in most cases, only income tax return in Form ITR-3 is filed.
Disadvantages
- Unlimited Liability
A proprietorship has unlimited liability. If the business fails, the creditors can recover their dues not merely from the business assets, but also the personal assets of the proprietor.
- Limited Life
In the eyes of the law the Proprietorship and the owner are considered the same. Death, insolvency or illness of a proprietor affects the business and can lead to its closure.
- Limited Funds
The sole proprietor is at a disadvantage in raising sufficient capital. The capital may be limited and personal assets may also be insufficient for raising loans against their security.
- Taxes & Licence
The sole proprietor pays taxes individually because all forms of capital are invested by the owner and all the licences are registered by the name of the proprietor.
