Trademark Objection
A trademark is a type of intellectual property that characterizes your product or service and distinguishes it from other products or services on the market, although trademarks are used to identify services that are usually called service marks. After the trademark application is filed, the trademark examiner examines the trademark and it can object to due to certain reasons. An objection does not mean rejection to the trademark filed but the examiner will want you to clarify the reasons for the objection.
When an objection is raised, the applicant is given 30 days period to submit a written reply for the
objection raised.
Reasons for Trademark Objection
- Filing Incorrect Form
When the application filed for trademark contains false or incorrect information, it is more prone to get an objection. - Existing Similar Trademark
The Trademark Examiner can also raise an objection if a similar trademark already exists. - Incorrect Name
If the name of the applicant is incorrect or there is a spelling mistake. - Misleading Terms
If the name of the Trademark is misleading or the products or the services is deceptive in nature then the Examiner can raise an objection. - Offensive Terms
If the Trademark application contains any offensive or obscene content then it can be objected.
